The following are frequently asked questions that have been answered by the Board. If you have a question that is not answered here, please contact the Board using the contact information from the Board.

Why does the LMNSC have a Bylaws document?

Answer:  The Bylaws document is used by the Board to guide them in the oversight of the LMNSC.  It provides a framework of the responsibilities of the Board members and outlines the rules of how the business of the LMNSC is to be conducted.

When the LMNSC was formed in 2005, Bylaw documents from other Co-ops in MN were obtained and referenced.  The members of the LMNSC made changes and updates to those documents and eventually agreed on what the content of the Bylaws should be when the LMNSC was originally formed.

Why does the LMNSC also have an Occupancy Agreement document?

Answer:  The LMNSC Occupancy Agreement is a document that all cabin owners must sign to purchase a cabin that is part of the LMNSC.   The document is intended to provide the rules of interaction between the LMNSC and LMNSC members.

Does Rice County require permits for updates to cabins or shorelines?

Answer:  Yes.   Rice County requires permits for many significant updates to cabins and shorelines.  Please refer to the Rice County Departments page to obtain information regarding what type of permits are needed for what type of projects (http://www.co.rice.mn.us/148/Departments).

Do I need to submit requests to the Board in writing?

Answer:  Yes

Any request that you have should be submitted to any member of the Board in writing.  

If the request is related to a permit you are seeking, please refer to the “Permits” section of Exhibit D of the LMNSC Bylaws.  There you will find the information the Board will ask you to submit. 

Do I need to contact/notify the LMNSC Board prior to submitting a permit request to Rice County?  

Answer:  Yes and No. 

You do not have to contact the LMNSC Board prior to discussing things with Rice County.  However, since Rice County recognizes that the LMNSC Board is the governing body for the land that your cabin resides on, they prefer you discuss and receive written approval from the LMNSC Board prior to discussing your request with the county.

Rice County will require that you have written approval from the LMNSC Board before they will approve any permit.

Do I have to discuss requests with my neighbors prior to approaching the Board?

Answer:  It is preferred.

When reviewing requests from LMNSC members, the Board will take into consideration how the request will impact the cabins nearest to your cabin.   The Board prefers you include written documentation of any correspondence with your neighbors about the requests at the time you submit a request.  

Obviously, the Board prefers that all neighbors are supportive of the request.   However, the Board reserves the right to approve a request without the support of all neighbors.

What are the LMNSC Rules?

Answer:  Article V, Section A, Item 3 of the LMNSC bylaws indicates that it is the responsibility of the Board to: “Adopt and publish rules (Exhibit D) and regulations governing the use of the Common Areas and the personal conduct of the Stockholders, their family members who reside on the premises, and their guest. “

  • Stockholder rights
    • Pets
    • Fires
    • Garbage/Trash
    • Personal Conduct
    • Permits
    • Sale of Unit
    • Hunting
    • ATVs/Dirtbikes
    • Cutting Trees
    • Insurance for items stored/located on “common ground”
    • Clarification of areas considered to be “common ground”
    • Rules governing the placement of a shed on “common ground”
